Basically you will not get banned. Actually less likely of getting banned than with the other version which permanently edits read-only files. So this is "safer".

The warning is just there for haters to have a failsafe way to not get banned at all (but since you don't run the server via Steam, Steam will not even load the VAC module)

Uh.. so if you have MW3 or another game open you will get banned?

Chances for that are the same than with @OrangePL's version. lim n->infty (1/x)

Running MW3 and joining a VAC secure server will activate the scan for forbidden external modules. There's, however, a higher chance that this utility will be added to this list than a modified version of a core-shipped executable, especially due to specificity of such a check.

Steam won't check the file as of now since VAC is not loaded since it's not required to be logged into Steam at all in order to run a dedicated server.
As soon as this changes, this still is less likley to be bannable than Orange's version (since that one is really modified on the HDD)

I am running it on a true dedicated server, no steam running, no client files at all so a ban isn't really possible. It is possible they could block the ip on the master server so nobody could see it.

I'll set up a second server with this exe and let you know how the two compare

Bullshit. VAC is not running and the number 1 thing VAC scans for (IF IT WOULD RUN) is changed read-only files (exe/dll-files).
Then it starts checking for other things and this thing might even get away with it (since the tool is done working before the dedi server even started up).

L2VAC.

(and again: VAC does not even start up; how to see this? Be out of any game so your Steam Status is blue (online/away/busy/w/e). Then start the dedi via this tool. It will stay blue. This means Steam doesn't even know you started something so it does not even load the VAC library into itself (which it does when you start the multiplayer via Steam).

Note how I said 'running MW3 and ...' - for instance, if joining your own local server.
