The phrase under responsibility to the courts provides the main concept of the freedom: the constitution grants you the freedom to say whatever you please, but does not protect you from being punished for doing so. Tradition by the court is that the boundaries for what is deemed inappropriate are wider for the press or in a political debate than for civil citizens.
The major punishable acts are libel, blasphemy and racism, which are restricted by the Danish penal code. Like most other countries, Denmark also forbids publishing copyright-protected material without permission and revealing trade secrets in the civil law.
In 2005, Denmark got a joint first place in Reporters Without Borders Worldwide press freedom index.
The Eastern High Court today fined Lars Hedegaard, the president of the Free Press Society, 5,000 kroner for making racially offensive comments in December 2009.

Todays decision overturns a decision in January by the Frederiksberg District Court, which stated that while it found Hedegaards comments to be insulting, Hedegaard did not know that his controversial comments would be made public.

Last week Hedegaard published a book titled Muhammeds Piger (Mohammeds Girls), in which he writes about issues such as discrimination in Islam and that the belief in predestination.

Women are the main focus of the book, in which the author also expresses his joy over the victory of free speech, referring to the district courts acquittal in January.
Jesper Langballe, church spokesperson for the Danish Peoples Party (DF), was on Friday convicted of making defamatory statements about Muslims.

Langballe pleaded guilty to the charge of defamation under the anti-racism section of the penal code.

In January, Langballe wrote a letter to Berlingske Tidende newspaper in which he commented on claims made by the chairman of the Free Press Society, Lars Hedegaard, that Muslim fathers rape their daughters.
In his letter, Langballe supported Hedegaards views, saying that Hedegaard should not have written that Muslim fathers rape their daughters, when the truth seems to be that they only kill them (the so-called honour killings) and turn a blind eye when uncles rape them.

Langballe lashed out at the laws banning racist speech, and for allowing courts to convict people based on whether the defendant felt violated or defamed, and not whether the statements made are actually true or false, he said.

Given this section and its position within the penal code, I have to believe that Im being convicted in advance of the trial. I have no intention of participating in such a charade. Thats why I confess.

Langballe was sentenced to pay 5,000 kroner.
Free Press Society head said to have made racist remarks against Muslims

The chairman of the Freedom of the Press Society, Lars Hedegaard, has been charged with making racist remarks by the Public Prosecutor for Copenhagen.

The charge comes after Hedegaard on the blog site Snaphanen in December 2009 described rape as common in Muslim families, especially girls by their uncles, cousins or fathers.

Hedegaard told Jyllands Posten newspaper that he had was not worried about the charge but was interested to see how the situation will play out.

In a press release published later he stated that his statement did not cover all Muslims, but was a critique of Islam in general.

Despite the change in comment, though, the Public Prosecutor has chosen to stand by the charge.

Asked if he regretted the comment, Hedegaard said the only thing he regretted was the misunderstanding, but that he hoped for an opportunity to rectify this.

The charges prompted Hedegaard to leave the Danish Peoples Party in order to avoid having his comments reflect negatively on the nationalist political party.

Following Hedegaards comments, numerous prominent members left the society. Liberal politician Sren Pind and the Conservative Naser Khader have both left and vicar and speaker Kathrine Liller said that she was thrown out of the society after not supporting the chairman.
The world has moved on from prosecuting Jews. To the best of my knowledge adultery is more of a norm here. Priests raping young boys is a world-wide problem.
